Le Condizioni Generali di Vendita regolano l\u2019acquisto dei prodotti effettuato a distanza tramite rete internet dal Sito abeatrecords.com e jazzandmore.it. Il Sito mette a disposizione LP, CD e DVD. I servizi resi disponibili dal Sito sono quelli collegati alla vendita dei prodotti sopra citati.
\nTitolare del Sito \u00e8 Edizioni Musicali ABEAT di Caccia Mario & C. snc, con sede legale Solbiate Olona,\u00a0 partita IVA\/codice fiscale 02453100121, iscritta al Registro delle Imprese C.C.I.A.A. di VARESE dal 24\/07\/1998 con REA 258815.
\nI Contratti d\u2019Acquisto di prodotti effettuati attraverso il Sito dai Clienti sono regolati dalle Condizioni Generali di Vendita. Eventuali eccezioni concesse al Cliente in deroga alle Condizioni Generali saranno efficaci esclusivamente se autorizzate per iscritto.
\nLe disposizioni delle Condizioni Generali trovano applicazione per tutti i Clienti, eccettuate le disposizioni esplicitamente previste per i Clienti Consumatori. Per Cliente Consumatore s\u2019intende una persona fisica che acquisti i prodotti offerti dal Sito per scopi estranei all\u2019attivit\u00e0 imprenditoriale o professionale.
\nE\u2019 necessario, prima di effettuare una operazione d\u2019acquisto, leggere con attenzione le presenti Condizioni Generali nonch\u00e9 stamparle e conservarne copia qualora si concluda una procedura d\u2019acquisto.
\nQualora il Cliente desideri ricevere fattura per i prodotti acquistati dovr\u00e0 comunicarlo al momento dell\u2019ordine inviando gli elementi previsti dalla normativa I.V.A. di riferimento, in particolare dovr\u00e0 far pervenire numero di partita IVA e codice fiscale.
\nOve disponibile sar\u00e0 resa la rappresentazione visiva dei prodotti sotto forma di immagine fotografica con lo scopo di presentarli per la vendita, senza alcuna garanzia o impegno relativamente l\u2019esatta corrispondenza dell\u2019immagine raffigurata sul Sito con il prodotto reale con particolare riferimento alle sue dimensioni effettive, aspetti cromatici delle copertine e\/o delle confezioni.
\nLe Condizioni Generali contenute nel presente documento potranno essere modificate in qualsiasi momento e senza preavviso. The General Terms and Conditions of Sale govern the purchase of products made remotely over the Internet from the abeatrecords.com Site and jazzandmore.co.uk. The Site makes available LPs, CDs and DVDs. The services made available by the Site are those related to the sale of the products mentioned above.
\n<\/em><\/span>The owner of the Site is Edizioni Musicali ABEAT di Caccia Mario & C. snc, with registered office Solbiate Olona, VAT number\/tax code 02453100121, registered at the Register of Companies C.C.I.A.A. of VARESE since 24\/07\/1998 with REA 258815.
\n<\/em><\/span>Product Purchase Contracts made through the Site by Customers are governed by the General Conditions of Sale. Any exceptions granted to the Customer in derogation of the General Conditions shall be effective only if authorized in writing.
\n<\/em><\/span>The provisions of the General Conditions apply to all Customers, except for the provisions explicitly provided for Consumer Customers. A Consumer Customer is defined as a natural person who purchases products offered by the Site for purposes unrelated to his\/her business or professional activity.
\n<\/em><\/span>It is necessary, before making a purchase transaction, to carefully read these General Terms and Conditions as well as print them out and keep a copy if a purchase procedure is concluded.
\n<\/em><\/span>If the Customer wishes to receive an invoice for the purchased products, he\/she must communicate this at the time of the order by sending the elements required by the relevant VAT regulations, in particular he\/she must send VAT number and tax code.
\n<\/em><\/span>Where available will be made the visual representation of the products in the form of photographic image with the purpose of presenting them for sale, without any guarantee or commitment regarding the exact correspondence of the image depicted on the Site with the real product with particular reference to its actual size, color aspects of the covers and \/ or packaging.

\nLa proposta d\u2019acquisto inoltrata dal Cliente previa registrazione sul Sito trover\u00e0 riscontro tramite una risposta automatica inviata all\u2019indirizzo di posta elettronica comunicato dal Cliente. Tale risposta, inviata unicamente quale conferma di ricevimento della proposta d\u2019acquisto,\u00a0 indicher\u00e0 un numero ordine nonch\u00e9 i dati inseriti dal Cliente il quale, qualora ravvisi inesattezze, \u00e8 tenuto a darne immediata comunicazione al fine di permettere le necessarie correzioni.
\nDal momento dell\u2019invio dell\u2019ordine il Cliente potr\u00e0 prendere visione dello stesso sul Sito nella sua area personale.

\nThe purchase proposal forwarded by the Customer after registration on the Site will be acknowledged by an automatic response sent to the e-mail address provided by the Customer. This response, sent only as confirmation of receipt of the purchase proposal, will indicate an order number as well as the data entered by the Customer who, if it detects inaccuracies, is required to give immediate notice in order to allow the necessary corrections.<\/em><\/span>
\nFrom the moment the order is sent, the Customer will be able to view it on the Site in his personal area.<\/em><\/span>

\nLa disponibilit\u00e0 alla spedizione dei prodotti indicata sul Sito non \u00e8 aggiornata in tempo reale.\u00a0 Pur garantendo il massimo impegno nel procedere celermente all\u2019invio dei prodotti indicati come disponibili al momento di effettuazione dell\u2019ordine da parte del Cliente, pu\u00f2 accadere che l\u2019effettiva disponibilit\u00e0 di un prodotto vari in maniera sensibile nel corso della giornata rispetto all\u2019indicazione riportata.
\nNon si assume quindi alcun impegno n\u00e9 si garantisce la certezza di evasione immediata di prodotti acquistati e indicati come disponibili sul Sito. Allo stesso modo non si assumono responsabilit\u00e0 per eventuali ritardi nella consegna.

\nProduct prices and availability, as stated on the Site, are subject to change at any time without notice. For pending orders, the terms and conditions of sale in effect at the time the Customer submits the order shall apply.<\/em><\/span>
\nThe availability for shipment of products indicated on the Site is not updated in real time.\u00a0 While guaranteeing maximum effort in proceeding quickly to send the products indicated as available at the time of placing the order by the Customer, it may happen that the actual availability of a product varies significantly during the day compared to the reported indication.<\/em><\/span>
\nTherefore, no commitment is made or guarantee of immediate fulfillment of products purchased and indicated as available on the Site. Similarly, no responsibility is assumed for any delays in delivery.<\/em><\/span>
\nShould the delivery time of the ordered product be significantly delayed with respect to the delivery time indicated on the Site prior to ordering, the Customer will be promptly notified by e-mail.<\/em><\/span>[\/vc_column_text]\t<\/div>\n<\/div>

\nAl momento della conclusione del Contratto d\u2019Acquisto il Cliente decider\u00e0 la modalit\u00e0 di pagamento.<\/p>\n

PayPal\/Carta di credito
\n<\/strong>Il pagamento avviene comodamente ed istantaneamente utilizzando un gateway sicuro e rinomato: PayPal. E\u2019 possibile effettuare il pagamento anche se non si \u00e8 titolari di un conto PayPal inserendo i dati della carta di credito in tutta sicurezza.<\/p>\n

Bonifico bancario
\n<\/strong>E\u2019 un metodo di pagamento sicuro e veloce. Insieme alla conferma dell\u2019ordine saranno inviati i dati necessari per effettuare il bonifico. Normalmente l\u2019accredito del bonifico avviene entro 36\/48 ore dalla disposizione impartita dal Cliente alla sua banca.<\/p>\n

Contrassegno
\n<\/strong>La somma indicata al momento del perfezionamento del Contratto d\u2019Acquisto sar\u00e0 pagata per contanti all\u2019addetto alla consegna della merce.Non saranno accettati altri mezzi di pagamento salvo il caso di limitazione all\u2019uso del contante previsto dalla leggi vigenti. Unicamente in tale caso potranno essere convenute deroghe alla norma che prevede esclusivamente un pagamento per contanti.
\nL\u2019addetto alla consegna non potr\u00e0 richiedere somme aggiuntive a quella convenuta nel Contratto d\u2019Acquisto.
\nLa modalit\u00e0 di pagamento con contrassegno\u00a0 prevede un costo aggiuntivo (diritto di contrassegno) di Euro 2,57 che sar\u00e0 conteggiato al completamento della procedura d’acquisto unitamente alle spese di trasporto.<\/p>\n

PayPal\/Credit Card<\/strong><\/em><\/span>
\nPayment is made conveniently and instantly using a secure and renowned gateway: PayPal. It is possible to make payment even if you do not have a PayPal account by entering your credit card details securely.<\/em><\/span><\/p>\n

Bank transfer<\/strong><\/em><\/span>
\nThis is a secure and fast payment method. Together with the confirmation of the order will be sent the necessary data to make the transfer. Normally the crediting of the transfer occurs within 36\/48 hours from the provision given by the Customer to his bank.<\/em><\/span><\/p>\n

Cash on delivery<\/strong><\/em><\/span>
\nThe amount indicated when finalizing the Purchase Agreement will be paid in cash to the person in charge of the delivery of the goods.No other means of payment will be accepted except in the case of limitation to the use of cash provided by the laws in force. Only in such a case may exceptions to the rule that payment by cash only may be agreed upon.<\/em><\/span>
\nThe delivery person may not request additional sums to that agreed upon in the Purchase Agreement.<\/em><\/span>
\nThe mode of payment by cash on delivery provides for an additional cost (cash on delivery fee) of Euro 2.57 that will be counted at the completion of the purchase procedure together with the transport costs.<\/em><\/span><\/p>\n

\n<\/strong>Premesso che sul Sito \u00e8 indicato per ogni articolo il tempo di spedizione (ad es.\u00a0 spedito in 1-2 giorni lavorativi ), in caso di ordini di pi\u00f9 prodotti il pacco contenente quanto ordinato sar\u00e0 consegnato al corriere quando tutti i prodotti ordinati saranno disponibili con la conseguenza che i tempi di evasione potranno variare a seconda dei prodotti ordinati.
\nQualora in fase di evasione di un ordine un prodotto non sia pi\u00f9 disponibile (ad es. perch\u00e9 andato fuori catalogo) sar\u00e0 inviata al Cliente una e-mail di informazione.<\/p>\n

Costi di spedizione
\n<\/strong>Acquisti di importo uguale o superiore ad Euro 80,00 usufruiranno del trasporto gratuito, diversamente sar\u00e0 addebitato un contributo pari ad Euro 5,50.
\nSi evidenzia che in caso di pagamento con modalit\u00e0 alla consegna il relativo diritto di contrassegno di Euro 2,57 sar\u00e0 conteggiato unitamente alle spese di trasporto.<\/p>\n

Trasporto
\n<\/strong>Attualmente effettuiamo spedizioni esclusivamente sul territorio Italiano isole comprese tramite Corriere Espresso che normalmente provvede alla consegna entro due giorni dal momento della spedizione.
\nE\u2019 importante che al momento della consegna dei prodotti da parte del vettore il Cliente verifichi il numero dei colli e l\u2019integrit\u00e0 dell\u2019imballo.
\nNel caso l’imballo non risulti integro \u00e8 necessaria l’accettazione della spedizione con riserva.
\nIl recapito dei prodotti ordinati presuppone la presenza del Cliente o di un suo incaricato nel luogo di prevista consegna. In caso di assenza del Cliente (o di un suo incaricato), il vettore lascer\u00e0 un avviso di seconda consegna per il giorno lavorativo successivo ed un recapito telefonico per poter concordare una diversa data di consegna.
\nQualora durante la fase di lavorazione dell’ordine si dovessero verificare degli imprevisti che causano ritardi nella sua evasione (ad es. sciopero dei corrieri) ne sar\u00e0 data tempestiva comunicazione al Cliente tramite e-mail.
\nIn caso di ritardo nell\u2019evasione dell\u2019ordine o nella consegna, nessuna responsabilit\u00e0, a qualsiasi titolo, potr\u00e0 essere imputata al mittente.[\/vc_column_text][vc_empty_space css=”.vc_custom_1655383997408{margin-bottom: 32px !important;border-bottom-width: 1px !important;border-bottom-color: #e0e0e0 !important;border-bottom-style: solid !important;}”][vc_column_text]Order fulfillment<\/strong><\/em><\/span>
\nProvided that on the Site is indicated for each item the shipping time (e.g. shipped in 1-2 working days ), in case of orders for multiple products the package containing what was ordered will be delivered to the courier when all the products ordered are available with the consequence that the processing time may vary depending on the products ordered.<\/em><\/span>
\nIf during fulfillment of an order a product is no longer available (e.g. because it has gone out of stock) an e-mail of information will be sent to the Customer.<\/em><\/span><\/p>\n

Shipping costs<\/strong><\/em><\/span>
\nPurchases of an amount equal to or greater than Euro 80.00 will benefit from free shipping, otherwise a contribution of Euro 5.50 will be charged.<\/em><\/span>
\nIt should be noted that in case of payment by cash on delivery mode, the relevant cash-on-delivery fee of Euro 2.57 will be charged together with the transport costs.<\/em><\/span><\/p>\n

Transport<\/strong><\/em><\/span>
\nWe currently make shipments exclusively on the Italian territory including islands via Express Courier that normally provides delivery within two days from the time of shipment.<\/em><\/span>
\nIt is important that upon delivery of the products by the carrier, the Customer checks the number of packages and the integrity of the packaging.<\/em><\/span>
\nIn case the packaging is not intact, acceptance of the shipment with reservation is required.<\/em><\/span>
\nThe delivery of the ordered products presupposes the presence of the Customer or his agent at the place of intended delivery. In case of absence of the Customer (or his agent), the carrier will leave a notice of second delivery for the next business day and a telephone number so that a different delivery date can be arranged.<\/em><\/span>
\nIf unforeseen events occur during the processing of the order that cause delays in its fulfillment (e.g. courier strike) the Customer will be promptly notified by e-mail.<\/em><\/span>
\nIn case of delay in the order processing or delivery, no liability, for any reason whatsoever, can be attributed to the sender.<\/em><\/span>[\/vc_column_text][vc_column_text][\/vc_column_text]\t<\/div>\n<\/div>

\n\t\t[vc_column_text]Per esercitare il diritto di recesso, il Cliente Consumatore dovr\u00e0 inviare comunicazione in tal senso tramite il Sito entro e non oltre 14 giorni lavorativi dalla data di ricevimento dei prodotti. Tale comunicazione, entro 48 ore dal suo invio, dovr\u00e0 essere confermata con lettera raccomandata con avviso di ricevimento spedita al Titolare del Sito.
\nLa restituzione dovr\u00e0 avvenire a cura del Cliente Consumatore, attraverso la spedizione dei prodotti oggetto del recesso, a mezzo corriere di propria scelta. I prodotti dovranno essere spediti, entro e non oltre 10 giorni lavorativi a decorrere dalla data di consegna, all\u2019indirizzo che sar\u00e0 opportunamente comunicato.
\nAi fini del valido esercizio dell\u2019anzidetto diritto di recesso, il Cliente Consumatore dovr\u00e0 rispettare le seguenti condizioni e modalit\u00e0:<\/p>\n

  • i prodotti formanti oggetto di Contratti d\u2019Acquisto in relazione ai quali il Cliente Consumatore abbia esercitato il diritto di recesso dovranno risultare integri e restituiti nella confezione originale, completa in tutte le sue parti, in particolare dai prodotti audiovisivi non dovranno risultare rotti o asportati i sigilli di confezionamento e i contrassegni SIAE;<\/li>\n
  • il recesso potr\u00e0 applicarsi anche limitatamente a singoli prodotti formanti oggetto di un unico Contratto d\u2019Acquisto, fermo restando che il recesso si applica al prodotto nella sua interezza ossia il Cliente Consumatore non potr\u00e0 esercitare il recesso limitatamente ad una parte del singolo prodotto acquistato (es. un solo Compact Disc presente in un cofanetto);<\/li>\n
  • il Cliente Consumatore provveder\u00e0, a proprio esclusivo onere e cura, alla spedizione e restituzione dei prodotti.<\/li>\n<\/ul>\n

    Una volta verificata la perfetta integrit\u00e0 del prodotto restituito, si provveder\u00e0 al rimborso di quanto dovuto al Cliente Consumatore\u00a0 per i prodotti di cui al Contratto d\u2019Acquisto oggetto di recesso entro e non oltre 30 giorni dal rientro dei prodotti medesimi. Il rimborso avverr\u00e0 mediante bonifico bancario sul conto di cui il Cliente Consumatore avr\u00e0 comunicato le esatte coordinate.[\/vc_column_text][vc_empty_space css=”.vc_custom_1655383997408{margin-bottom: 32px !important;border-bottom-width: 1px !important;border-bottom-color: #e0e0e0 !important;border-bottom-style: solid !important;}”][vc_column_text]To exercise the right of withdrawal, the Consumer Customer must send notice to that effect via the Site no later than 14 working days from the date of receipt of the products.     \nThe return must be made by the Consumer Customer, through the shipment of the products subject to withdrawal, by courier of his choice. The products must be shipped, no later than 10 working days from the date of delivery, to the address that will be appropriately communicated.<\/em><\/span>
    \nFor the valid exercise of the aforementioned right of withdrawal, the Consumer Customer must comply with the following terms and conditions:<\/em><\/span><\/p>\n

    • the withdrawal may also apply limited to individual products forming the subject of a single Purchase Agreement, it being understood that the withdrawal applies to the product in its entirety that is, the Consumer Customer may not exercise the withdrawal limited to a part of the single product purchased (e.g. a single Compact Disc present in a box set);<\/em><\/span><\/li>\n
    • the Consumer Customer will provide, at its sole responsibility and care, for the shipment and return of products.<\/em><\/span><\/li>\n<\/ul>\n

      Once verified the perfect integrity of the returned product, we will refund the amount due to the Consumer Customer for the products referred to in the Purchase Agreement subject to withdrawal no later than 30 days after the return of the products themselves.
